Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the relationship between Logie Web Services NZ ("Developer", "I", or "my") and the client ("Client", "you", or "your") for web development services provided in New Zealand.

1. Scope of Service

My web design service includes:

• Written content for your nominated pages based on information you provide
• Image sourcing - I will source and place relevant high-quality images to complement your content
• Design formatting to match your existing branding or suggesting appropriate design options
• On-page SEO including targeted keyword analysis for your business and region
• Contact forms, Google maps, and inter-page links for easy website navigation
• Responsive design for mobile and smart device compatibility
• Delivery of your draft website preview within 15 business days of receiving complete information
• Two structured revision rounds for edits
• Self-management editing access after website publication
• Email support throughout the website build process

2. Additional Services (Charged Separately)

• Additional pages beyond the agreed scope
• Specialized content writing (e.g., technical subjects, product descriptions)
• High volume content upload (exceeding 800 words per page)
• Custom photo modifications or processing of large quantities of images
• Custom graphic design work
• Integration with external applications
• Phone consultations for revisions (my standard service is email-based)

3. Exclusions to My Service

• Off-page SEO services such as backlink building
• Guarantees of specific Google page rankings
• Google Ads campaigns and management
• Complex eCommerce solutions
• Comprehensive graphic design services
• Member registration or user login systems
• Content in languages other than English (with some Te Reo exceptions)

4. Client Responsibilities

• Provide all necessary content, images, logos, and materials in a timely manner
• Review work and provide feedback within agreed timeframes
• Ensure all provided content complies with New Zealand law and does not infringe on third-party intellectual property rights
• Complete the question list I provide to initiate website development
• Communicate design preferences clearly before development begins

5. Fair Use Policy

My services are designed to support small businesses with a straightforward web presence. I reserve the right to apply additional charges or limit services if requests exceed reasonable usage:

• Edit revision rounds: 2 revisions included in fixed price. Additional revisions charged at $15 NZD per half-hour
• Design revisions: Initial design based on your guidance is included. Significant redesigns due to change of mind will incur a fee of $150 per revision
• If your requests exceed my standard service offering, I may advise of additional charges, limit services, or offer a refund of your deposit

6. Payment Terms

• All fees are specified in individual project quotes or agreements (in NZD unless otherwise specified)
• Payment schedule:
  - 40% deposit required before work begins
  - Remaining payment due upon project completion
  - Monthly payments for ongoing services
• Late payments may incur a $10 fee after 7 days
• Work may be suspended on overdue accounts
• Additional work outside agreed scope charged at $15 NZD per half-hour
• All deposits are non-refundable unless otherwise agreed in writing

7. Website Development Process

Pre-Design Phase
• All quotes valid for 30 days
• If I don't receive your completed information within 3 months of deposit, your account may be suspended
• Work commences once I receive your complete information

Design Phase
• Draft delivery within 15 business days of receiving complete information
• Design preferences must be submitted before drafting begins
• Significant design changes after initial draft may incur additional fees

Edit and Review Process
• Two revision rounds included
• All edits should be submitted in a consolidated format
• If no edits are provided within 3 months of draft provision, I reserve the right to close your account

8. Money Back Guarantee

If you have provided all requested information and followed my process but are still unhappy with your website, you may request either:

• A redesign at no additional charge, or
• A full refund of your deposit

To be eligible for a refund:

• Request must be made during the review phase
• You must have provided specific guidance I did not follow
• You must give me an opportunity to redesign your site first

Exceptions (when refunds will not be issued):

• If you've already approved your draft website
• If design changes are due to your change of mind
• If you discontinue your business during development
• If I receive abusive communication

9. Intellectual Property

• You retain all rights to content, logos, and materials you provide
• I retain rights to custom code, development frameworks, and generic components
• Full transfer of applicable rights occurs upon receipt of final payment
• I reserve the right to include the project in my portfolio

10. Warranty and Liability

My liability is limited to the amount paid for services. I am not liable for any indirect, consequential, or incidental damages including loss of revenue, anticipated profits, or business delays.

11. Termination

Either party may terminate the agreement with 30 days written notice. You agree to pay for all work completed up to the termination date. A cancellation fee of 20% of the remaining project value may apply for early termination.

12. Communication Policy

My service is email-based during the development process. I respond better to positive communication and appreciate clear, concise requests. I reserve the right to refuse continued service if any communication is abusive or threatening in nature.

13. Governing Law

These Terms are governed by New Zealand law. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.
